What is Mechanical Permit?

A mechanical permit is written approval from a local building department to install, replace or alter heating, cooling and ventilation equipment, usually followed by an inspection of the finished work. In Greater Houston, cities such as Houston, Sugar Land, Pearland, Missouri City and Katy issue their own, while unincorporated areas follow state code standards.

Why it matters to you

Permit rules change at city limits across Greater Houston: the Houston Permitting Center requires a mechanical permit for HVAC alterations including condensing-unit replacement, and Sugar Land doubles its FY25 $115 replacement permit fee when work starts before the permit is issued. A permit and passed inspection give you third-party proof the work met code when you sell or file an insurance claim.

Practical guidance

Ask every bidder how the permit will be handled for your specific address and whether it appears on the quote. This is general guidance, not legal advice; confirm current requirements and fees with your local building department before work begins.

Do I need a permit to replace my AC in Greater Houston?

In most incorporated cities, yes. The Houston Permitting Center requires a mechanical permit for HVAC alterations including condensing-unit replacement, Sugar Land requires a permit for HVAC repair, replacement or addition, and the City of Katy requires a permit for AC and heating installation and registration of contractors. Confirm with your city's building department before work starts.

How much does an HVAC permit cost in Houston-area cities?

Fees are set by each city. Sugar Land's FY25 fee ordinance lists $115 for an HVAC replacement permit, doubled if work starts before the permit; Pearland lists a $60 residential mechanical fee; Missouri City lists a $35 application fee for its mechanical permit. Other cities publish their own schedules, so confirm current fees with the building department.

What if I live in Spring, Aldine, Cinco Ranch, Fresno or The Woodlands?

These are unincorporated areas, and no county residential mechanical permit was found for them in our research. That does not mean there is no standard: under Texas rule 16 TAC §75.100(e), air conditioning work on one- and two-family homes must still meet the applicable state code editions. Confirm with your county whether any permit applies to your address, and in The Woodlands check Township covenant rules too.

Which code do Houston-area cities use for HVAC work?

It varies. Pearland uses the 2021 International Mechanical Code, Missouri City references the 2021 IRC and IMC, and Sugar Land has adopted the 2024 International Codes. Code editions change on each city's own schedule, so check with the building department for the edition in force when your permit is issued.

Who applies for the HVAC permit, me or the contractor?

It depends on the city's rules. Typically the licensed air conditioning contractor applies, and Katy also requires contractors to register with the city. Ask each bidder in writing how the permit will be handled for your address, and verify their TDLR license before you sign.
