What is HOA and Covenant Equipment Rules?

HOA and covenant equipment rules are deed-restriction requirements, enforced by a homeowners association or community authority, that govern where outdoor HVAC equipment may sit, how it looks, and whether replacing it needs approval. In The Woodlands, Section 2.2 of the Township's 2024 Residential Development Standards addresses outdoor condensing unit placement, color, and replacement.

Why it matters to you

Under §2.2 of The Woodlands Township's 2024 Residential Development Standards, replacement compressors must meet current code, outdoor units are to be earth-toned and located in a side or rear yard, and replacing a unit in the same location is pre-approved. Relocating or adding equipment falls outside that pre-approval, so check before planning it.

Practical guidance

Before replacing or moving outdoor equipment, read your community's current deed restrictions or development standards and confirm with your HOA or The Woodlands Township whether an application is needed. This is general guidance, not legal advice; covenant approval is separate from any building permit, so confirm permit needs with your local building department.
