Replacing an AC in The Woodlands: Township Covenant Rules to Know First

By JHC Cooling and Heating Team Published

Quick answer

The Woodlands Township's 2024 Residential Development Standards (§2.2) set the rules for outdoor AC units. Replacing a unit in the same location with a color-compatible model is pre-approved, but compressors must meet current building code and pass a third-party inspection. Units should be earth-tone and sit in the side or rear yard, three or more grouped units need screening, and window units are side or rear only, one per lot.

The standards are revised from time to time, and other recorded documents may also apply to your lot. What are The Woodlands covenant rules for air conditioners?

The Woodlands covenant rules for air conditioners are the equipment requirements in The Woodlands Township's Residential Development Standards, the community-wide standards that govern how homes and lots in The Woodlands may be changed. Section 2.2 of the 2024 edition (pages 32–33) addresses outdoor air conditioning compressors and window units.

These standards are separate from building codes. A building code governs how equipment is installed safely; the Township's standards govern where outdoor equipment may go and how it looks from the street and from neighboring lots. The Township's Development Standards Committee adopts and administers the standards, and the Township's Covenant Administration department is the point of contact for questions.

In The Woodlands, an AC replacement has two sets of rules to satisfy: the building code and the Township's covenants.

What does Section 2.2 require for AC compressors?

Section 2.2 of the 2024 Residential Development Standards sets out these requirements for air conditioning equipment:

Air conditioning equipment requirements, The Woodlands Township 2024 Residential Development Standards §2.2 (pp. 32–33), as reviewed October 16, 2026
Topic What the standard says What it means for a replacement
Code compliance Compressors must meet the current building code and pass a third-party inspection Plan for an inspection of the new installation; ask Covenant Administration how to document it
Like-for-like replacement Replacement in the same location with a color-compatible unit is pre-approved Keeping the new unit where the old one sat, in a compatible color, is the simplest path
Location and color Units should be earth-tone and placed in the side or rear yard Moving a unit, especially toward the front of the home, needs a closer look before work starts
Multiple units Screening is required where three or more units are grouped together Adding a system next to two existing units can trigger a screening requirement
Window units Allowed in side or rear locations only, with a maximum of one per lot A window unit cannot go on the front of the home

When do the covenant rules apply to your project?

The covenant rules apply whenever outdoor air conditioning equipment is installed, replaced, moved or added on a residential lot in The Woodlands. The situations homeowners run into most:

  • Straight replacement in the same spot. A color-compatible unit in the same location is pre-approved under §2.2, though the new compressor must still meet current building code and pass a third-party inspection.
  • Relocating the outdoor unit. New placement has to fit the side or rear yard rule. Ask Covenant Administration whether an application is needed before you commit.
  • Adding a system for an addition, garage conversion or second floor. Check whether the new total puts three or more units together, which requires screening.
  • Upsizing equipment. Newer high-efficiency outdoor units can have a different footprint from the old one, so confirm the new unit still fits the existing pad and location.
  • Window units. Side or rear only, one per lot.

What about a county permit?

The Woodlands is not an incorporated city, so there is no city permit office. Our research did not find a county residential mechanical permit for The Woodlands; the state code standard in 16 TAC §75.100(e) still applies, requiring work on one- and two-family homes to meet the applicable International Residential Code where no local code has been adopted. Confirm with your county, Montgomery or Harris depending on your address. Our Greater Houston HVAC permit guide compares the rules across the region.

What can go wrong if you skip the covenant check?

Skipping the covenant check can mean equipment that has to be screened, repainted or moved after it is already installed. The most common trouble spots:

  • A unit moved toward the front of the house to shorten a refrigerant line run or free up yard space.
  • A bright or non-earth-tone cabinet where the existing unit blended in.
  • A third unit added beside two existing ones without the required screening.
  • No record of the third-party inspection, which the standards call for on compressors.
  • Assuming a neighbor's setup is the rule. Older installations may predate the current standards; what applies to your project is the current edition.

Covenant enforcement is handled by the Township, and remedies depend on the situation, so the safest approach is to ask before work begins rather than after.

Who provides electricity in The Woodlands, and why does it matter?

Electricity in The Woodlands is split between two utilities by address: some homes are served by Entergy Texas, which is not open to retail electric choice, and others by CenterPoint Energy, which is in the competitive retail market. Knowing which one serves your home matters for an AC replacement because utility efficiency programs, outage reporting and electricity rates all depend on your utility. Your electric bill or the Township's utilities page will tell you which area you are in.

Two homes on opposite sides of The Woodlands can have different electric utilities, so check yours before comparing efficiency programs.

How can you confirm what applies to your home?

You can confirm what applies to your home with a few checks before any equipment is ordered:

  1. Note where your current unit sits and photograph it, including its color and any screening.
  2. Read §2.2 of the 2024 Residential Development Standards on the Township's website.
  3. Contact The Woodlands Township Covenant Administration if you plan to move, add or change the look of equipment, and ask whether an application is needed.
  4. Ask how the third-party inspection required for compressors should be documented.
  5. Check your county for any permit requirement at your address.
  6. Get the new unit's dimensions and cabinet color in writing with your quote.

What should you do before replacing your AC in The Woodlands?

Before replacing an AC in The Woodlands, decide whether the replacement is truly like-for-like, then confirm the covenant and county requirements in writing. If the new unit goes in the same spot in a compatible earth-tone color, the covenant side is usually the simplest part of the project. If anything about location, color or number of units changes, check with Covenant Administration first.
